im not expert but if it is anonymous there is no copyright? and if it is sent to be an part of a public Consultation anyone should be able to read it

Interesting that a document for a public consultation should need to be 'private', but the use of innuendo against named people is probably best kept off a public access website. The lawyers would be the only people to earn any money from what might be libel actions. However to send legal papers out you need to know the author and their address and I am sure it is not 'Bridget Jones'.

HI Malcolm my long suffering chess playing friend who happens to be a lawyer regularly reminds me that he charges £175 plus VAT an hour! to those who dont drive him around the country to chess tournaments (me). I think he would say that an unsigned diatribe to a public body is very much in the public domain and if it were to appear here or elsewhere the author has no case against anyone; persons whose character has been attacked in such a way would be those in a position to pursue action but if the other party has no money then only lawyers get rich!
Having spoken to Mike today one can only conclude that the authors of such compositions are avid fans of Enid Blighton.

Spoke to my lawyer friend this morning about our next chess league game on Tuesday (our team is top of the league-sorry had to get that one in) and just happened to broach the subject about the unsigned diatribe. In plain mans language not lawyer speak; if the owner of a webb site publishers the information and that person is also the person attacked in the document then thats is perfectly all right and is not actionable. The document is unsigned therefore there are no copyright issues.
The problem would be if for example some other person got hold of the document ,other than the one being attacked, and published it on a webb site then the owner of the webb site could become libel for an action by the person attacked if he felt his character was being attacked publically without cause.. Simply put, the individual who has been attacked slanged off or whatever can publish what he likes where he likes so long as the doucment has not been signed by the originator and endorsed not for publication.
Seems to me that the document should be published and thus may flush out the originator or at the least prevent him/her from proliferating more rubbish; the more who read it the clearer it would become as to who the person is.
I think I know who it could be and all I can say if he reads this dont bother contacting me any further asking for information about boats cos I am not going to reply. I dont like those who hide in the shadows dishing out attacks in unsigned drivel. Getting a life would appear to be a perfectly good aim to direct ones energies.
